4. Consent
We collect your information with your consent, or where the law permits (performance of a contract, legal obligation, legitimate interest). You may withdraw your consent at any time (see section 11); however, this withdrawal may prevent us from providing you with certain services.
5. Profiling and automated decisions
We do not use your information to profile you or to make a decision based exclusively on automated processing that produces legal effects concerning you. Any identification, location or profiling technology present on the site is disabled by default and is activated only with your consent.
6. Cookies
The site uses cookies necessary for its operation and, with your consent, audience-measurement and marketing cookies. Non-essential cookies are disabled until you consent via our consent banner. The details (name, purpose, duration, third party) are in our cookie policy.
7. Disclosure to third parties
We do not sell your information. We disclose it only to the providers necessary for our services, bound by confidentiality commitments:
| Provider | Role |

[To verify and complete according to your actual tools: audience analytics, newsletter, etc.]
We may also disclose information if required by law (legal request from an authority).
8. Transfer outside Québec
Some of our providers (notably Stripe, PayPal, Cloudflare and Anthropic) process data outside Québec, primarily in the United States. Before entrusting this information, we assess that the protection offered is adequate, in accordance with Law 25, and we govern these transfers through appropriate agreements. For individuals in the EU, these transfers rely on the mechanisms provided by the GDPR (standard contractual clauses or adequacy decisions).
9. Retention
We retain your information for as long as necessary for the purposes described, then to comply with our legal, accounting and tax obligations (notably the retention of billing records required in Canada). Beyond that, it is securely destroyed or anonymized.
10. Security
We implement reasonable technical and organizational measures (encryption in transit, access control, logging, firewall) to protect your information against loss, unauthorized access or disclosure.
11. Your rights
Subject to the law, you may exercise the following rights by writing to [email protected]:
- Access to your information and rectification;
- Withdrawal of consent;
- Portability: receive your computerized information in a structured, commonly used technological format;
- De-indexing / cessation of dissemination in the cases provided for by Law 25;
- for the EU (GDPR): erasure, restriction, objection, and the right to lodge a complaint with your supervisory authority.
We respond within the time limits provided by law (generally 30 days). In Québec, you may also file a complaint with the Commission d’accès à l’information (CAI).
12. Privacy incidents
In the event of a privacy incident presenting a risk of serious injury, we take reasonable measures to reduce its effects, keep a register of incidents, and notify the Commission d’accès à l’information as well as the individuals concerned, in accordance with Law 25.
13. Information concerning minors
Our services are intended for a professional clientele (agencies, developers, site owners). We do not knowingly collect information from minors under 14 without the required consent.
14. The Maintenance GENIUS plugin
This policy covers the maintenancegenius.ca site and store. The behavior of the plugin installed on your own WordPress site (for example its GDPR mode, its logging of blocked access attempts) is described in the plugin’s documentation and readme file.
